Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website porterbuyshouses.com (the “Site”) and the services provided by PortBuys Houses LLC (“we,” “us,” or “our”). By accessing or using our Site or services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

1. About Us

PortBuys Houses LLC is an Ohio limited liability company engaged in the business of purchasing residential real estate for cash. We make offers to homeowners on qualifying properties throughout the State of Ohio. We are real estate investors and purchasers; we are not a real estate brokerage, a law firm, a foreclosure consultant, a loan modification service, a credit repair service, or a debt relief agency. We do not provide legal, financial, or housing counseling services.

2. Description of Services

Our services include:

  • Reviewing information submitted by property owners
  • Providing cash offers on qualifying residential properties
  • Coordinating closings on properties we agree to purchase

Submitting information through our Site does not create any obligation on either party. Any offer we may extend is non-binding until a written purchase agreement is executed by both parties.

3. SMS / Text Messaging Program

This section describes the terms of our SMS messaging program.

Program Name: PortBuys Houses Property Inquiry Messaging

Program Description: When you submit your phone number and provide consent through a form on our Site, you are enrolling in our SMS messaging program. Messages may include responses to your property inquiry, appointment scheduling, transaction updates, and follow-up communications.

Eligibility: You must be at least 18 years old and the account holder or authorized user of the mobile number you submit. By providing your mobile number, you represent and warrant that you have the authority to consent to receive SMS messages at that number.

Message Frequency: Message frequency varies based on your interaction with us.

Cost: Message and data rates may apply, depending on your mobile carrier and plan. PortBuys Houses LLC does not charge you for the messages, but your carrier may.

Opt-Out Instructions: You can cancel the SMS service at any time by replying “STOP” to any text message you receive from us. After you send “STOP,” you will receive one final confirmation message, and we will not send you any further SMS messages unless you opt back in. If you want to rejoin the program, sign up again through any form on our Site.

Help: For help, reply “HELP” to any message you receive from us, or contact us at the information listed in Section 12.

Carrier Disclaimer: Carriers (including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, and other participating carriers) are not liable for delayed or undelivered messages.

Supported Carriers: Our SMS program is compatible with most major U.S. mobile carriers. Message delivery is not guaranteed and depends on carrier coverage and conditions.

Consent Is Not a Condition of Purchase: Consent to receive marketing or promotional SMS messages is not a condition of receiving any offer, service, or transaction from us.

4. Use of the Site

You agree to use our Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Submit false, misleading, or fraudulent information
  • Use the Site to harass, threaten, or harm any person
  • Attempt to gain unauthorized access to any portion of the Site or any system connected to it
  • Use automated tools, bots, or scrapers to access the Site
  • Interfere with the proper functioning of the Site
  • Use the Site for any purpose that violates applicable law

5. No Guarantees; Offers Are Estimates

Any property valuation, cash offer estimate, or general statement on the Site about prices we typically pay is provided for informational purposes only. Actual offers depend on many factors, including property condition, location, title status, comparable sales, repair costs, and market conditions at the time of the offer.

No statement on this Site constitutes a binding offer. Any binding offer must be made in writing and signed by an authorized representative of PortBuys Houses LLC. Any binding agreement to purchase must be set forth in a separate written purchase agreement signed by both parties.

We do not guarantee that we will make an offer on any particular property, that any offer will close, that any foreclosure will be stopped, prevented, or delayed, or that any specific timeline or outcome will be achieved.

6. Not Legal, Financial, or Tax Advice

Information on our Site is provided for general informational purposes only. It is not legal, financial, tax, or real estate advice. You should consult with qualified professionals — including attorneys, accountants, real estate professionals, and HUD-approved housing counselors — before making decisions about your property or your finances. We encourage homeowners facing foreclosure to also explore free counseling resources available through the U.S. Department of Housing and Urban Development at hud.gov.

7. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PORTBUYS HOUSES LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE IS LIMITED TO ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless PortBuys Houses LLC and its members, managers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of any third party.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Champaign County, Ohio, and you consent to the jurisdiction and venue of those courts.

11. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last Updated” date above. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
